Influencer marketing: Important nodes are identified within related communities, known as influencers. This is becoming an important concept in digital targeting. CHARLESTON, W.Va. — The West Virginia Retailers Association is pleased with a change of heart by Governor Jim Justice. This week the Justice Administration announced a change in tax policy in which internet companies who do business in the Mountain State will have to collect and remit West Virginia sales tax for online purchases, even though those companies have no brick and mortar presence in the Mountain State. . Earlier this year, Governor Justice announced he would oppose the change out of a concern for putting another burdensome tax on consumers.
“For years, brick-and-mortar retailers have suffered at the hands of online sellers, not only from whatever superior service or features are offered by the online sellers, but by the tax exemption they enjoyed under previous law,” he said. “This decision corrects that. If online sellers provide a superior product, that’s the nature of competition, but they should not enjoy a legislated advantage in the tax code.”
NRF, representing both small retailers and big-box merchants, from Walmart and Target to Best Buy and Macy’s, isn’t the only one that’s happy about the ruling. In another sign of the disruptive impact of Amazon and digital native startups including eyeglasses label Warby Parker and mattress brand Casper, more than 20 other trade groups — from the National Grocers Association and the National Association of College Stores to the American Supply Association and the Auto Care Association — joined NRF in March in a brief supporting the South Dakota case on internet sales tax collection.

(a)   Requirement to File Tax Return.  An Internet vendor subject to 830 CMR 64H.1.7(3) must file a tax return in the form and manner prescribed by the Commissioner and pay the tax due for each calendar month on or before the 20th day of the following calendar month, whether or not the vendor must collect any other local or state excises.  For applicable record retention requirements, see 830 CMR 62C.25.1:  Record Retention.
Some online marketplace operators display the property of various sellers, process the sellers’ transactions and provide various other services, but the terms of sale dictate and the receipts and other documents related to the sales reflect that the consumers are purchasing the property directly from the sellers. In these instances, the marketplace operators are generally just providing a service, and the seller that lists the property on the marketplace is the retailer making a retail sale to the consumer.

In the United States, certain electronic commerce activities are regulated by the Federal Trade Commission (FTC). These activities include the use of commercial e-mails, online advertising and consumer privacy. The CAN-SPAM Act of 2003 establishes national standards for direct marketing over e-mail. The Federal Trade Commission Act regulates all forms of advertising, including online advertising, and states that advertising must be truthful and non-deceptive.[26] Using its authority under Section 5 of the FTC Act, which prohibits unfair or deceptive practices, the FTC has brought a number of cases to enforce the promises in corporate privacy statements, including promises about the security of consumers' personal information.[27] As a result, any corporate privacy policy related to e-commerce activity may be subject to enforcement by the FTC.
Subjecting small business owners to burdensome taxes may bring some revenue for states, but at the high cost of stifling growth and limiting opportunity. Congress could pass a small business exception that would differentiate eight-person businesses such as Chad White’s from retail giants, allowing those smaller companies to do what they do best: serve customers, and create jobs and hopefully grow into new robust competitors.

The new digital era has enabled brands to selectively target their customers that may potentially be interested in their brand or based on previous browsing interests. Businesses can now use social media to select the age range, location, gender and interests of whom they would like their targeted post to be seen by. Furthermore, based on a customer's recent search history they can be ‘followed’ on the internet so they see advertisements from similar brands, products and services,[38] This allows businesses to target the specific customers that they know and feel will most benefit from their product or service, something that had limited capabilities up until the digital era.

With more choices of products, the information of products for customers to select and meet their needs become crucial. In order to address the mass customization principle to the company, the use of recommender system is suggested. This system helps recommend the proper products to the customers and helps customers make the decision during the purchasing process. The recommender system could be operated through the top sellers on the website, the demographics of customers or the consumers' buying behavior. However, there are 3 main ways of recommendations: recommending products to customers directly, providing detailed products' information and showing other buyers' opinions or critiques. It is benefit for consumer experience without physical shopping. In general, recommender system is used to contact customers online and assist finding the right products they want effectively and directly.[74]

Although online marketing creates many opportunities for businesses to grow their presence via the Internet and build their audiences, there are also inherent challenges with these methods of marketing. First, the marketing can become impersonal, due to the virtual nature of message and content delivery to a desired audience. (b)   A provider of Internet access service or online services (a “provider”) is not deemed to be the agent of a vendor for purposes of determining the application of 830 CMR 64H.1.7(3) to such vendor solely as a result of:  1. the display of such vendor’s information or content on the provider’s out-of-state computer server, or  2. the processing of orders through the provider’s out-of-state computer server.  See id.

The history of sales taxes in the U.S. isn't that old. Sales taxes in the U.S. have traditionally been the right of the individual states, who started requiring merchants to charge tax on items for sale in the late 1920s and into the Great Depression. Sales taxes were seen as a way to help fund state activities in an era of low income. Today, all states except Alaska, Delaware, Montana, New Hampshire, and Oregon charge sales tax. 
The Wayfair ruling could also have wide-ranging consequences for marketplaces such as Amazon and Etsy, where the companies already collect sales tax on their own products, but not on behalf of third-party sellers. This brings up the question of whether marketplaces will now step in to absorb the cost of collecting sales tax on behalf of partner retailers. In some states, notes Barrett, "marketplace facilitator legislation would require the Amazons and the Etsys to collect sales tax on their behalf. In some respects, that would be easier for the smaller sellers," she adds. Still, it's conceivable that marketplaces could refuse to do so in other states--or sell hefty compliance assistance packages that would hurt their sellers, she suggests.
The field is replete with terms that might confuse and perplex the average individual. What is a squeeze page? What's a sales funnel? What's a CPA? What's SEO? How do you setup a good blog to filter the right type of relevant traffic and get your offer in front of eligible users? What's a massive value post (MVP) really mean? Clearly, there are an endless array of terms, some of which you might already know or might not depending on how much you presently know about the field.
Otherwise Subject to Tax.  Massachusetts sales or use tax jurisdiction over a vendor that is conferred by in-state contacts other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c.  For example, an Internet vendor with a principal place of business located outside the state might maintain inventory in the state or contract with an in-state representative (including a related person) that creates sales or use tax jurisdiction.  Only a vendor that is not “otherwise subject to tax” is potentially subject to the rule set forth in 830 CMR 64H.1.7(3).

You also must have a Texas permit if you live outside the state but are engaged in business here. An out-of-state seller must get a Texas permit and collect Texas tax if the seller has Texas outlets, Texas salespersons, or otherwise comes into Texas to conduct business, such as soliciting sales, performing services, or making deliveries. An out-of-state seller is subject to Texas sales and use tax in the same way as sales made by any other retail business located in Texas.
