CHARLESTON, W.Va. — The West Virginia Retailers Association is pleased with a change of heart by Governor Jim Justice. This week the Justice Administration announced a change in tax policy in which internet companies who do business in the Mountain State will have to collect and remit West Virginia sales tax for online purchases, even though those companies have no brick and mortar presence in the Mountain State. . Earlier this year, Governor Justice announced he would oppose the change out of a concern for putting another burdensome tax on consumers.
Passing legislation that prohibits an internet sales tax would be the best course. But if there isn’t enough political will in Congress to do the right thing to protect taxpayers and consumers, which is too often the case, members should listen to the concerns of their constituents who are small business owners and craft legislation that immediately protects these crucial entrepreneurs from onerous taxes and helps them thrive and sets a responsible tax system.

In Quill, the Supreme Court discusses not only physical presence, but also several types of potential nexus (connections) between a business and a state. Many states, including Texas, have used the term nexus rather than physical presence in their sales tax laws, regulations, or other official documents, and have sometimes defined nexus in ways that could go beyond physical presence.
If the above conditions apply, you are required by law to collect, report and remit the appropriate state and local sales and use tax on taxable items delivered to customers in Texas. The sales price includes all shipping and handling charges. "Taxable items" include all tangible personal property as well as taxable services. Not all states are cheering the Supreme Court's ruling. Officials in New Hampshire, which doesn't have a sales tax, say the decision could force its businesses to collect taxes for other states. Republican Gov. Chris Sununu and Democratic lawmakers also said the ruling will create red tape that hinders the ability of small businesses to grow and create jobs.

(b)   Prior Tax Periods. An Internet vendor may have engaged in in-state contacts other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. during tax periods prior to September 22, 2017.  In these cases, the vendor is liable for tax for such prior tax periods if:  1. the contacts created sales or use tax jurisdiction and; 2. the vendor did not collect and remit the tax.  For example, for purposes of illustration only, an Internet vendor with a principal place of business located outside Massachusetts may have previously:  a. owned or maintained inventory or other property in the state; or  b. contracted with an in-state representative (including a related person) other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c., and thereby created state sales or use tax jurisdiction.  In these cases, the Internet vendor would have been subject to tax on all of its Massachusetts sales for the tax periods in question.  Such a vendor may seek to use the Department of Revenue’s voluntary disclosure program for such prior periods.

Regardless of what happens with the proposed federal legislation, the Supreme Court's decision in the Wayfair case is expected to mean the collection of substantially more money for states from sales tax. And for remote sellers, the decision may mean they will need sales tax software to keep up to date on which states and localities collect sales tax and at what rate.

Small online sellers may not have to collect internet sales taxes. The South Dakota law makes smaller online sellers to be exempt from collecting sales tax if they have less than $100,000 in annual sales or fewer than 200 transactions. Other states will have different minimums. If you have a very small online business it's likely that you won't be affected.

Meanwhile, in a recent statement regarding the ruling, Wayfair--which generated nearly $5 billion in sales last year and already collects sales tax in most jurisdictions--insisted the decision would not impact its bottom line: "Wayfair already collects and remits sales tax on approximately 80 percent of our orders in the U.S., a number that continues to grow as we expand our logistics footprint," the CEO said.
