Many retailers are choosing to use online marketplaces (also referred to as eCommerce marketplaces or eMarketplaces) to sell their products instead of, or in addition to, selling through their own websites. An online marketplace is a website where third-party sellers list products for sale, and the sales of such products are processed by the operator of the website (marketplace operator). Some online marketplaces offer products for sale by the marketplace operator as well as third-party sellers. Others exclusively serve as a marketplace for third-party sellers.
(b) Prior Tax Periods. An Internet vendor may have engaged in in-state contacts other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. during tax periods prior to September 22, 2017. In these cases, the vendor is liable for tax for such prior tax periods if: 1. the contacts created sales or use tax jurisdiction and; 2. the vendor did not collect and remit the tax. For example, for purposes of illustration only, an Internet vendor with a principal place of business located outside Massachusetts may have previously: a. owned or maintained inventory or other property in the state; or b. contracted with an in-state representative (including a related person) other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c., and thereby created state sales or use tax jurisdiction. In these cases, the Internet vendor would have been subject to tax on all of its Massachusetts sales for the tax periods in question. Such a vendor may seek to use the Department of Revenue’s voluntary disclosure program for such prior periods.
One simplification is already in existence. It has been suggested by a previous Marketplace Fairness Act to expand an existing organization to help keep the process of collecting internet sales taxes fair. This non-profit organization, called Streamlined Sales Tax (SST)was created in 1999 as a way to i "simplify and modernize sales tax administration." At present, 44 states have agreed to participate, with centralized administration and reciprocity agreements, standardized tax rates, and uniform tax bases.
Customers are often researching online and then buying in stores and also browsing in stores and then searching for other options online. Online customer research into products is particularly popular for higher-priced items as well as consumable goods like groceries and makeup. Consumers are increasingly using the Internet to look up product information, compare prices, and search for deals and promotions.
(a) 830 CMR 64H.1.7(3) does not apply if the vendor’s only contacts with Massachusetts are that in-state customers may access a site on the vendor’s out-of-state computer server. Further, the mere fact that in-state customers may access such site, without more, will not be considered a factor in determining a vendor’s tax collection obligation. See ITFA § 1105.

You can register on the BOE website at www.boe.ca.gov, by selecting New Registration, and then select Register a business activity with BOE. Once you have registered, you may pay any use tax due by filing your return. You can also register to report use tax in person at any of our field offices.
Most people need to take a step back and understand where money is even coming from on the web. Sharpe says that, when asked, most individuals don't actually even know how money is being made on a high level. How does Facebook generate its revenues? How about Google? How do high-trafficked blogs become so popular and how do they generate money from all of that traffic? Is there one way or many?
Among the specific evidence presented by the court? Less than 2% of Americans had internet access in 1992, compared with about 89% today. Last year, e-commerce sales alone totaled $454 billion. When combined with traditional catalog and other “remote” sales, that figure topped half a trillion dollars. What’s more, since the Department of Commerce first began tracking online sales, e-commerce has surged tenfold, to nearly 9% of total U.S. retail sales, from just 0.8% — a number that will likely become larger with online sales growing at four times the rate of brick-and-mortar retail.
Subjecting small business owners to burdensome taxes may bring some revenue for states, but at the high cost of stifling growth and limiting opportunity. Congress could pass a small business exception that would differentiate eight-person businesses such as Chad White’s from retail giants, allowing those smaller companies to do what they do best: serve customers, and create jobs and hopefully grow into new robust competitors.
Understanding Mobiles: Understanding mobile devices is a significant aspect of digital marketing because smartphones and tablets are now responsible for 64% of the time US consumers are online (Whiteside, 2016). Disadvantages of digital media used on mobile devices also include limited creative capabilities, and reach. Although there are many positive aspects including the users entitlement to select product information, digital media creating a flexible message platform and there is potential for direct selling (Belch & Belch, 2012).
As previously explained either sales or use tax applies to the retail sale of tangible personal to a California consumer through an online marketplace, unless the sale is specifically exempt or excluded from tax. If, as described above, you are a California retailer or an out-of-state retailer that is engaged in business in California and you are the retailer for purposes of the sale, then you are liable for any applicable sales tax or you are responsible for collecting applicable use tax from the customer.

Among emerging economies, China's e-commerce presence continues to expand every year. With 668 million Internet users, China's online shopping sales reached $253 billion in the first half of 2015, accounting for 10% of total Chinese consumer retail sales in that period. The Chinese retailers have been able to help consumers feel more comfortable shopping online. e-commerce transactions between China and other countries increased 32% to 2.3 trillion yuan ($375.8 billion) in 2012 and accounted for 9.6% of China's total international trade. In 2013, Alibaba had an e-commerce market share of 80% in China. In 2014, there were 600 million Internet users in China (twice as many as in the US), making it the world's biggest online market. China is also the largest e-commerce market in the world by value of sales, with an estimated US$899 billion in 2016.
Using Dr Dave Chaffey's approach, the digital marketing planning (DMP) has three main stages: Opportunity, Strategy and Action. He suggests that any business looking to implement a successful digital marketing strategy must structure their plan by looking at opportunity, strategy and action. Small online sellers may not have to collect internet sales taxes. The South Dakota law makes smaller online sellers to be exempt from collecting sales tax if they have less than $100,000 in annual sales or fewer than 200 transactions. Other states will have different minimums. If you have a very small online business it's likely that you won't be affected.
In June, the High Court issued a ruling in the case of Wayfair v. South Dakota, allowing states to require online retailers to collect sales tax--even in areas where they don't have a physical presence. It has been a month since the decision, and already many small businesses are considering their options for how to address, among other things, higher tax-compliance costs in a potentially reduced-sales environment.
There's a wild card, however: More than half of the units sold on Amazon worldwide last year came from third-party sellers, including many small- and medium-sized merchants. David Fildes, head of Amazon’s investor relations, said in its most recent earnings call in April that Amazon collects taxes on behalf of third-party sellers in Washington and Pennsylvania (per those states' rules). “We're not opposed to collecting sales tax” within a system that’s both “simple and applied evenhandedly,” he said.

You do not need to collect sales tax on items you deliver directly to out-of-state locations. To document such a sale, your records must include proof of delivery, such as a bill of lading, a shipping invoice or a postal receipt. You may have to collect tax in another state if you are engaged in business there. You should contact the states where you buy or ship merchandise to find out if you are responsible for paying or collecting their taxes. The Multistate Tax Commission has a useful website at http://www.mtc.gov with links to the tax websites of other states.
Conversion rate optimization is still possibly one of the most underutilized but critical functions of digital marketing. The power of your SEO rankings are only as good as your click through rates and your traffic is only valuable of your website and landing pages foster some type of “action.” Why spend all the time and energy driving traffic through multiple different channels if you are not willing to spend the time and energy on conversion optimization?
