States would have to meet certain criteria to simplify their sales tax laws and make sales tax collection easier before they could require sellers to collect the tax.

Passing legislation that prohibits an internet sales tax would be the best course. But if there isn’t enough political will in Congress to do the right thing to protect taxpayers and consumers, which is too often the case, members should listen to the concerns of their constituents who are small business owners and craft legislation that immediately protects these crucial entrepreneurs from onerous taxes and helps them thrive and sets a responsible tax system.

It is the long established physical presence rule that will apply with regard to Internet sales to customers in Texas. Online sellers with possible in-state agent or related party status should check the rules more carefully. This is a contentious and evolving area of law so be sure to check in periodically with the Texas Comptroller of Public Accounts to see if the rules have changed.

With over 10,000 different tax jurisdictions across the nation, the burden for small businesses would be crushing. This will create enormous costs for companies that have to navigate complex tax laws. Small sellers may need to pay accountants and lawyers to help them comply with these thousands of laws and may open themselves up to potential audits and other state regulations.
Subjecting small business owners to burdensome taxes may bring some revenue for states, but at the high cost of stifling growth and limiting opportunity. Congress could pass a small business exception that would differentiate eight-person businesses such as Chad White’s from retail giants, allowing those smaller companies to do what they do best: serve customers, and create jobs and hopefully grow into new robust competitors.
The history of sales taxes in the U.S. isn't that old. Sales taxes in the U.S. have traditionally been the right of the individual states, who started requiring merchants to charge tax on items for sale in the late 1920s and into the Great Depression. Sales taxes were seen as a way to help fund state activities in an era of low income. Today, all states except Alaska, Delaware, Montana, New Hampshire, and Oregon charge sales tax. 
None of them ever passed, though. With the Supreme Court stepping into the fray on the Wayfair decision, it’s unlikely the federal government will be too anxious to dive back into this issue anytime soon. That said, as states get increasingly aggressive in their sales tax collection strategies, legal experts expect a long road of litigation and legislative changes ahead. That could provoke federal lawmakers to get involved.

Otherwise Subject to Tax.  Massachusetts sales or use tax jurisdiction over a vendor that is conferred by in-state contacts other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c.  For example, an Internet vendor with a principal place of business located outside the state might maintain inventory in the state or contract with an in-state representative (including a related person) that creates sales or use tax jurisdiction.  Only a vendor that is not “otherwise subject to tax” is potentially subject to the rule set forth in 830 CMR 64H.1.7(3).
Accountants further expect--and some are even advising their business clients to consider--moving operations out of states that have aggressive tax policies, such as Texas. "I've definitely heard that some clients are considering pulling out of some states," adds Virginia CPA Barrett. It's a viable option, she continues, "but it has to be part of the growth strategy and should be a well thought out decision."
E-commerce has the capability to integrate all inter-company and intra-company functions, meaning that the three flows (physical flow, financial flow and information flow) of the supply chain could be also affected by e-commerce. The affections on physical flows improved the way of product and inventory movement level for companies. On top of that, states are continually introducing new tax laws and modifying old ones to capture revenue on everything from streaming media to bicycles. The Wayfair ruling could also have wide-ranging consequences for marketplaces such as Amazon and Etsy, where the companies already collect sales tax on their own products, but not on behalf of third-party sellers. This brings up the question of whether marketplaces will now step in to absorb the cost of collecting sales tax on behalf of partner retailers. In some states, notes Barrett, "marketplace facilitator legislation would require the Amazons and the Etsys to collect sales tax on their behalf. In some respects, that would be easier for the smaller sellers," she adds. Still, it's conceivable that marketplaces could refuse to do so in other states--or sell hefty compliance assistance packages that would hurt their sellers, she suggests.
