A 1992 Supreme Court decision (the Quill v. N. Dakota case) attempted to address the issue of internet transactions. According to the Tax Foundation, the Quill decision said that a business "must have a physical presence in a state in order to require the collection of sales or use tax for purchases made by in-state customers." As a former state and local official, I know that many states will rush in and try to get their hands on additional revenue. Some states have already moved to begin collecting — some even on the smallest seller — and some have even threatened retroactive taxation. These officials will be more than happy to impose these burdens on businesses that don’t reside in their state and whose votes they don’t depend on.

One small business owner Chad White, the owner of Class-Tech Cars, a Virginia-based small business that sells reproduction automotive parts online, recently testified before Congress that he has a part-time employee who — before the Wayfair decision — was able to collect and remit all applicable sales taxes in just a few hours each week. I also received the 2 of the exact same recorded voice message. The one on 9/20/18 (213-568-4114, left a website address as amazonprofits.org. The 2nd one, the same recorded message (same voice, etc), came from phone number 850-842-5658, and website address left to contact or shop at was shoppersweb.org. I did not try them until recently due to a job loss. So here about 3 weeks later, although I figured they were scams, I tried to check into them. When I tried to check out either one of those websites, I was sent to a website that sold website domains. Interesting - doesn't sound like they keep the website very long either.

Yet television advertising is not directly competing with online digital advertising due to being able to cross platform with digital technology. Radio also gains power through cross platforms, in online streaming content. Television and radio continue to persuade and affect the audience, across multiple platforms (Fill, Hughes, & De Franceso, 2013).[45]

The other important factor in this equation is that the variables keep changing. It’s not like you can build a massive spreadsheet today and be ready for business tomorrow. Many states who were watching the Supreme Court case from the sidelines are about to pass new legislation. Six of them – Illinois, Iowa, Connecticut, Hawaii, Kentucky, and Vermont – already had laws in the works prior to the Supreme Court decision that were loosely modeled on the South Dakota law, and are slated to go into effect by January of next year. Others, such as Washington, emboldened by the Court’s decision, quickly introduced new legislation. Washington’s Department of Revenue announced the state’s new tax on out-of-state retailers on August 3 which will take effect on October 1 of this year.
Congress has attempted several times to pass what's been called a Marketplace Fairness Act to solve the problem, with no version making it through the process. The most recent of these acts is in suspension, waiting for the Court's decision. Both bills include exemptions for small sellers and ways to monitor sales tax collections and make the process more fair to all types of sellers.
The type of contacts referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. will generally establish state sales or use tax jurisdiction in the case of a non-Internet vendor when the U.S. constitutional requirements are met.  Thus, for example, a non-Internet vendor may be subject to sales or use tax jurisdiction based upon the in-state ownership or use of computer software or hardware, or the receipt of in-state services provided by a marketplace facilitator or delivery company.  The jurisdictional analysis in these cases is a facts and circumstances test.

Internet sales are treated just like sales made at retail stores, by sales representatives, over the telephone, or by mail order. If your business is located in California, retail sales of tangible personal property that you make over the Internet to California customers are generally taxable unless the sales qualify for a specific tax exemption or exclusion (see Nontaxable Sales), and you are required to register for a permit and report and pay tax to the same extent as any other retailer in California.

There's a lot to learn when it comes to the internet marketing field in general, and the digital ether of the web is a crowded space filled with one know-it-all after another that wants to sell you the dream. However, what many people fail to do at the start, and something that Sharpe learned along the way, is to actually understand what's going on out there in the digital world and how businesses and e-commerce works in general, before diving in headfirst.

Okay. Okay. There is a lot to learn. However, everyone has to start somewhere. If you're just being introduced to internet marketing, and you've become bedazzled by the glitz and the glamor of the top online income earners, know that it's not going to be easy to replicate their success. Be sure that you set your expectations the proper way. As long as you stay persistent, you can achieve your goals of generating healthy amounts of money online without becoming the victim of a scam.
As digital marketing continues to grow and develop, brands take great advantage of using technology and the Internet as a successful way to communicate with its clients and allows them to increase the reach of who they can interact with and how they go about doing so,.[2] There are however disadvantages that are not commonly looked into due to how much a business relies on it. (b)   A provider of Internet access service or online services (a “provider”) is not deemed to be the agent of a vendor for purposes of determining the application of 830 CMR 64H.1.7(3) to such vendor solely as a result of:  1. the display of such vendor’s information or content on the provider’s out-of-state computer server, or  2. the processing of orders through the provider’s out-of-state computer server.  See id.

Before online marketing channels emerged, the cost to market products or services was often prohibitively expensive, and traditionally difficult to measure.
