If you are a retailer that has a substantial nexus with California and you are not already registered with the BOE, you should register for a California Certificate of Registration—Use Tax. You can register on the BOE website at www.boe.ca.gov, by selecting New Registration, and then select Register a business activity with BOE. Once you have registered, you may pay any use tax due by filing your return. You can also register to report use tax in person at any of our field offices.

In 2016, South Dakota passed a law that would require out-of-state retailers to collect and pay internet sales tax in the same way and at the same rate as in-state retailers. The only applies to larger retailers who have more than $100,000 in sales or more than 200 sales transactions in a year in the state, sparing smaller sellers from the requirement to collect internet sales taxes. The state law would use the presence of the buyer in the state (a destination-based tax) as the requirement for collecting internet sales tax.

The type of contacts referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. will generally establish state sales or use tax jurisdiction in the case of a non-Internet vendor when the U.S. constitutional requirements are met.  Thus, for example, a non-Internet vendor may be subject to sales or use tax jurisdiction based upon the in-state ownership or use of computer software or hardware, or the receipt of in-state services provided by a marketplace facilitator or delivery company.  The jurisdictional analysis in these cases is a facts and circumstances test.
