Some companies voluntarily collect the Texas use tax, while others must collect it because they have some form of physical representation in Texas. Meanwhile, in a recent statement regarding the ruling, Wayfair--which generated nearly $5 billion in sales last year and already collects sales tax in most jurisdictions--insisted the decision would not impact its bottom line: "Wayfair already collects and remits sales tax on approximately 80 percent of our orders in the U.S., a number that continues to grow as we expand our logistics footprint," the CEO said.

CHARLESTON, W.Va. — The West Virginia Retailers Association is pleased with a change of heart by Governor Jim Justice. This week the Justice Administration announced a change in tax policy in which internet companies who do business in the Mountain State will have to collect and remit West Virginia sales tax for online purchases, even though those companies have no brick and mortar presence in the Mountain State. . Earlier this year, Governor Justice announced he would oppose the change out of a concern for putting another burdensome tax on consumers.

There's a wild card, however: More than half of the units sold on Amazon worldwide last year came from third-party sellers, including many small- and medium-sized merchants. David Fildes, head of Amazon’s investor relations, said in its most recent earnings call in April that Amazon collects taxes on behalf of third-party sellers in Washington and Pennsylvania (per those states' rules). “We're not opposed to collecting sales tax” within a system that’s both “simple and applied evenhandedly,” he said.
You also must have a Texas permit if you live outside the state but are engaged in business here. An out-of-state seller must get a Texas permit and collect Texas tax if the seller has Texas outlets, Texas salespersons, or otherwise comes into Texas to conduct business, such as soliciting sales, performing services, or making deliveries. An out-of-state seller is subject to Texas sales and use tax in the same way as sales made by any other retail business located in Texas.
If you are a seller making sales for resale to a marketplace operator in this manner, you should obtain a timely and properly completed resale certificate from your customer to support your claimed sales for resale (see Regulation 1668, Sales for Resale). However, if you are a retailer engaged in business in California and you ship the property directly to the consumer on behalf of a marketplace operator that is not engaged in business in California, you will be responsible for reporting and paying tax as a drop shipper. Since the Quill decision, states have become aggressive in expanding the definition of tax nexus in order to stop the outflow of tax revenues. Some states have taken a tax nexus to mean the presence of an affiliate. For example, Amazon sellers have been called affiliates, and California (among other states) has enacted state laws stating that the presence of an affiliate creates a tax nexus in that state, thus the requirement that sales tax be charged on all internet sales taxes from these affiliates.

In the United States, certain electronic commerce activities are regulated by the Federal Trade Commission (FTC). These activities include the use of commercial e-mails, online advertising and consumer privacy. The CAN-SPAM Act of 2003 establishes national standards for direct marketing over e-mail. The Federal Trade Commission Act regulates all forms of advertising, including online advertising, and states that advertising must be truthful and non-deceptive.[26] Using its authority under Section 5 of the FTC Act, which prohibits unfair or deceptive practices, the FTC has brought a number of cases to enforce the promises in corporate privacy statements, including promises about the security of consumers' personal information.[27] As a result, any corporate privacy policy related to e-commerce activity may be subject to enforcement by the FTC.
Internet sales made by out-of-state retailers to California customers are also treated no differently than other remote sales made to California customers. Generally, remote sales by out-of-state retailers to California customers, whether made over the Internet, by telephone, or mail order, take place outside of California because the property is delivered to a common carrier outside the state for shipment into California, and are, therefore, not subject to sales tax. However, California customers do owe the use tax on those sales, unless a specific tax exemption or exclusion applies. Out-of-state retailers that are engaged in business in California are required to register with the California State Board of Equalization (BOE), collect the use tax from California customers, and pay the tax to the BOE.
Not all states are cheering the Supreme Court's ruling. Officials in New Hampshire, which doesn't have a sales tax, say the decision could force its businesses to collect taxes for other states. Republican Gov. Chris Sununu and Democratic lawmakers also said the ruling will create red tape that hinders the ability of small businesses to grow and create jobs.
