After years of confusion, the internet sales tax issue was sent to the Supreme Court, in a case called S. Dakota v. Wayfair. In June 2018, the Court ruled for the state of South Dakota, saying that online sellers had an unfair advantage and that states have the right to require online sellers to charge and collect sales tax to buyers in their state.

To be clear, the South Dakota case on tax collection applies only to online retailers with more than $100,000 in annual sales or 200 transactions from the state. It remains to be seen how that threshold may play out with other states and whether most states would place the tax collection burden on third-party marketplace operators like Amazon, eBay or Etsy.

Online reviews, then, have become another form of internet marketing that small businesses can't afford to ignore. While many small businesses think that they can't do anything about online reviews, that's not true. Just by actively encouraging customers to post reviews about their experience small businesses can weight online reviews positively. Sixty-eight percent of consumers left a local business review when asked. So assuming a business's products or services are not subpar, unfair negative reviews will get buried by reviews by happier customers.

The Federal Trade Commission Act regulates all forms of advertising, including online advertising, and states that advertising must be truthful and non-deceptive.[26] Using its authority under Section 5 of the FTC Act, which prohibits unfair or deceptive practices, the FTC has brought a number of cases to enforce the promises in corporate privacy statements, including promises about the security of consumers' personal information.[27] As a result, any corporate privacy policy related to e-commerce activity may be subject to enforcement by the FTC.
(b)   Prior Tax Periods. An Internet vendor may have engaged in in-state contacts other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. during tax periods prior to September 22, 2017.  In these cases, the vendor is liable for tax for such prior tax periods if:  1. the contacts created sales or use tax jurisdiction and; 2. the vendor did not collect and remit the tax.  For example, for purposes of illustration only, an Internet vendor with a principal place of business located outside Massachusetts may have previously:  a. owned or maintained inventory or other property in the state; or  b. contracted with an in-state representative (including a related person) other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c., and thereby created state sales or use tax jurisdiction.  In these cases, the Internet vendor would have been subject to tax on all of its Massachusetts sales for the tax periods in question.  Such a vendor may seek to use the Department of Revenue’s voluntary disclosure program for such prior periods.

The Comptroller's office closely monitors out-of-state sellers to make sure they properly report and remit the tax they collect.

Passing legislation that prohibits an internet sales tax would be the best course. But if there isn’t enough political will in Congress to do the right thing to protect taxpayers and consumers, which is too often the case, members should listen to the concerns of their constituents who are small business owners and craft legislation that immediately protects these crucial entrepreneurs from onerous taxes and helps them thrive and sets a responsible tax system.
Of course, plenty of small businesses--brick-and-mortar shops in particular--cheered the decision, which they say levels the playing field for all businesses that sell goods, whether online or off. With it, the High Court moved to overturn a 1992 ruling--Quill v. North Dakota, in which many small businesses gained a competitive advantage--holding that any seller must have a physical presence in a state in order to be required to collect and remit tax. In other words, if your company didn't have a physical presence in Ohio, you could avoid charging taxes on your Ohio sales.

In some instances, the fulfillment center operator is a retailer itself that provides fulfillment services to third-party sellers at the same facilities from which it ships its own products.

To create an effective DMP, a business first needs to review the marketplace and set 'SMART' (Specific, Measurable, Actionable, Relevant and Time-Bound) objectives.[60] They can set SMART objectives by reviewing the current benchmarks and key performance indicators (KPIs) of the company and competitors. It is pertinent that the analytics used for the KPIs be customised to the type, objectives, mission and vision of the company.[61][62]

I also received the 2 of the exact same recorded voice message. The one on 9/20/18 (213-568-4114, left a website address as amazonprofits.org. The 2nd one, the same recorded message (same voice, etc), came from phone number 850-842-5658, and website address left to contact or shop at was shoppersweb.org. I did not try them until recently due to a job loss. So here about 3 weeks later, although I figured they were scams, I tried to check into them. When I tried to check out either one of those websites, I was sent to a website that sold website domains. Interesting - doesn't sound like they keep the website very long either.

(a)   830 CMR 64H.1.7(3) does not apply if the vendor’s only contacts with Massachusetts are that in-state customers may access a site on the vendor’s out-of-state computer server.  Further, the mere fact that in-state customers may access such site, without more, will not be considered a factor in determining a vendor’s tax collection obligation.  See ITFA § 1105.
However, that has not necessarily been the case for affiliate sellers on Amazon. Because these sellers didn’t have a physical presence in many, or in some cases any, areas where their products were sold, they often did not charge sales tax. But now that they are required to, it may not be that easy for those sellers to just flick a switch and become compliant.
There are two ways for marketers to conduct business through e-commerce: fully online or online along with a brick and mortar store. Online marketers can offer lower prices, greater product selection, and high efficiency rates. Many customers prefer online markets if the products can be delivered quickly at relatively low price. However, online retailers cannot offer the physical experience that traditional retailers can. It can be difficult to judge the quality of a product without the physical experience, which may cause customers to experience product or seller uncertainty. Another issue regarding the online market is concerns about the security of online transactions. Many customers remain loyal to well-known retailers because of this issue.[66][67]
