There's a wild card, however: More than half of the units sold on Amazon worldwide last year came from third-party sellers, including many small- and medium-sized merchants. The current default rule throughout the United States is that you must collect sales tax on Internet sales to customers in those states where your business has a physical presence. The physical presence rule is based on a 1992 United States Supreme Court decision, Quill Corp. v. North Dakota, that addressed the obligations of mail order businesses to collect sales tax on out-of-state sales. The decision has been extended to include online retailers. For additional guidance, check Rule 3.286 under Title 34 of the Texas Administrative Code, which provides definitions of when a seller is engaged in business in Texas. The Rule includes a statement that a person does not have nexus with the state simply because he or she has a certificate of authority to do business in the state. The Rule also states that an out-of-state seller with nexus with the state must collect sales tax.
It is the long established physical presence rule that will apply with regard to Internet sales to customers in Texas. Online sellers with possible in-state agent or related party status should check the rules more carefully. This is a contentious and evolving area of law so be sure to check in periodically with the Texas Comptroller of Public Accounts to see if the rules have changed.

To be clear, the South Dakota case on tax collection applies only to online retailers with more than $100,000 in annual sales or 200 transactions from the state. It remains to be seen how that threshold may play out with other states and whether most states would place the tax collection burden on third-party marketplace operators like Amazon, eBay or Etsy.
Even so, not everyone is thrilled. "As a small-business owner, the ruling signifies additional risk, uncertainty, cost, and a likely chill on small to mid-size e-commerce business formation, growth, and hiring," says Stephen Culp, the founder and chairman of Smart Furniture. The Chattanooga-based online furniture retailer declined to disclose its annual revenue, though it notes that sales are in the tens of millions, with fewer than 50 full-time employees.
The primary responsibility of an internet sales specialist is to manage all sales activities generated from the internet including managing sales leads to closing business. The type of contacts referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. will generally establish state sales or use tax jurisdiction in the case of a non-Internet vendor when the U.S. constitutional requirements are met.  Thus, for example, a non-Internet vendor may be subject to sales or use tax jurisdiction based upon the in-state ownership or use of computer software or hardware, or the receipt of in-state services provided by a marketplace facilitator or delivery company.  The jurisdictional analysis in these cases is a facts and circumstances test.
As a former state and local official, I know that many states will rush in and try to get their hands on additional revenue. Some states have already moved to begin collecting — some even on the smallest seller — and some have even threatened retroactive taxation. These officials will be more than happy to impose these burdens on businesses that don’t reside in their state and whose votes they don’t depend on.

Many states who were watching the Supreme Court case from the sidelines are about to pass new legislation. Washington’s Department of Revenue announced the state’s new tax on out-of-state retailers on August 3 which will take effect on October 1 of this year.

Internet Vendor.  A vendor that derives sales from transactions consummated over the Internet, whether such transactions are: (a) completed on a website maintained or operated by the vendor itself, or a website maintained or operated by a related person or a person with which the vendor contracts, including a marketplace facilitator and/or (b) fulfilled by a related person or a person with which the vendor contracts.  An Internet vendor, in addition to its Internet sales, may also derive sales from orders completed other than over the Internet.
One simplification is already in existence. It has been suggested by a previous Marketplace Fairness Act to expand an existing organization to help keep the process of collecting internet sales taxes fair. This non-profit organization, called Streamlined Sales Tax (SST)was created in 1999 as a way to i "simplify and modernize sales tax administration." At present, 44 states have agreed to participate, with centralized administration and reciprocity agreements, standardized tax rates, and uniform tax bases.
