Keeping up with the latest trends is a must for any business, but ignoring technology trends in the digital world is the matter of staying in business. Unfortunately, those trends (while easy enough to find mentioned online) are rarely explained well. There seems to be this mistaken idea that anyone who has an interest or need in the practice will just magically get the jargon. As we all know, that is one superpower that doesn’t exist in the real world.
And while large businesses, such as Amazon or Wayfair, may be able to easily absorb this cost, others would surely struggle to do so. "It's completely conceivable that the compliance costs alone could put people out of business," suggests Jesse Hathaway, a tax analyst with the conservative-leaning think tank Heartland Institute, based in Arlington Heights, Illinois.

For many years, states argued that they were losing a lot of money by not being able to collect sales tax on Internet sales to customers located in their states. Formerly the burden was on the customer rather than the seller to pay the relevant tax. In that case, the tax generally is called use tax rather than sales tax – and customers often simply did not pay use tax to the state.
When writing this guide, we reached out to the marketer community to collect case studies and learnings about creative marketing strategies. The current default rule throughout the United States is that you must collect sales tax on Internet sales to customers in those states where your business has a physical presence. The physical presence rule is based on a 1992 United States Supreme Court decision, Quill Corp. v. North Dakota, that addressed the obligations of mail order businesses to collect sales tax on out-of-state sales. The decision has been extended to include online retailers. Big retailers like Amazon are capable of deploying enterprise software that is sophisticated enough to account for different tax rates in multiple areas where a sale takes place. But if a five-person company with an Amazon, eBay, or Etsy store front, based out of a garage in Alabama, sells to a buyer in Chicago, they must now account for a 1.25% Chicago city sales tax, a 1.75% Cook County sales tax, the 6.25% Illinois sales tax, and a 1% “special” sales tax. That’s for just one sale to one city.

Internet sales are treated just like sales made at retail stores, by sales representatives, over the telephone, or by mail order. If your business is located in California, retail sales of tangible personal property that you make over the Internet to California customers are generally taxable unless the sales qualify for a specific tax exemption or exclusion (see Nontaxable Sales), and you are required to register for a permit and report and pay tax to the same extent as any other retailer in California.
In cases where the online retailer does not have to collect sales tax, it is the customer’s responsibility to pay the tax—in which case it is known not as a sales tax but, rather, a use tax. The TCPA states on its use tax FAQ page that one of the most common reasons for a purchaser being subject to use tax is purchasing a taxable item from an out-of-state retailer without paying Texas tax and using the property in Texas. The FAQ page goes on to state that if a purchaser purchases merchandise "through a catalog or the Internet from a seller located outside of Texas and use[s] the taxable item in Texas," then the purchaser owes use tax on the purchase. You can find more formal guidance about the use tax in Rule 3.346 if the Texas Administrative Code.
Sharpe says that you shouldn't dive into internet marketing until you decide on a niche and figure out what you're passionate about. Do you want to join the make-money-online (MMO) niche? There are however disadvantages that are not commonly looked into due to how much a business relies on it. According to the U.S. Commerce Department, consumers spent $453.46 billion on the web for retail purchases in 2017, a 16.0% increase compared with $390.99 billion in 2016. That’s the highest growth rate since 2011, when online sales grew 17.5% over 2010. Forrester predicts that online sales will account for 17% of all US retail sales by 2022. And digital advertising is also growing strongly; According to Strategy Analytics, in 2017 digital advertising was up 12%, accounting for approximately 38% of overall spending on advertising, or $207.44 billion.
If you are a seller making sales for resale to a marketplace operator in this manner, you should obtain a timely and properly completed resale certificate from your customer to support your claimed sales for resale (see Regulation 1668, Sales for Resale). However, if you are a retailer engaged in business in California and you ship the property directly to the consumer on behalf of a marketplace operator that is not engaged in business in California, you will be responsible for reporting and paying tax as a drop shipper. The challenge to overturn Quill v. North Dakota was brought to the Supreme Court by South Dakota. South Dakota passed a law two years ago demanding that all retailers that, on an annual basis, have more than $100,000 in annual sales or engage in 200 or more separate transactions, pay a 4.5 percent tax on all sales, “as if the seller had a physical presence in the State.” The state government then filed suit to have the case heard by higher courts, and the Supreme Court agreed to hear the argument earlier this year.
As for Amazon, which has been fast building its own last-mile delivery network and expanding into physical retail with the acquisition of Whole Foods and the openings of Amazon Go and Amazon Books, the ruling likely won't have any impact because Amazon already collects sales tax on its first-party sales in all 45 states that have a state-imposed sales tax.

Beginning January 1, 2016, sellers of prepaid wireless phone cards and services are required to collect a Prepaid Mobile Telephony Services (MTS) Surcharge from customers and pay it to the BOE for all retail transactions occurring in this state. The surcharge is imposed as a percentage of the sales price of prepaid wireless cards/services sold in retail transactions occurring in this state. Many retailers are choosing to use online marketplaces (also referred to as eCommerce marketplaces or eMarketplaces) to sell their products instead of, or in addition to, selling through their own websites. An online marketplace is a website where third-party sellers list products for sale, and the sales of such products are processed by the operator of the website (marketplace operator). Some online marketplaces offer products for sale by the marketplace operator as well as third-party sellers. Others exclusively serve as a marketplace for third-party sellers.
Internet sales made by out-of-state retailers to California customers are also treated no differently than other remote sales made to California customers. Generally, remote sales by out-of-state retailers to California customers, whether made over the Internet, by telephone, or mail order, take place outside of California because the property is delivered to a common carrier outside the state for shipment into California, and are, therefore, not subject to sales tax. However, California customers do owe the use tax on those sales, unless a specific tax exemption or exclusion applies. Out-of-state retailers that are engaged in business in California are required to register with the California State Board of Equalization (BOE), collect the use tax from California customers, and pay the tax to the BOE.
