For some business owners, they’ll think of a website. Others may think of social media, or blogging. In reality, all of these avenues of advertising fall in the category internet marketing and each is like a puzzle piece in a much bigger marketing picture. Unfortunately, for new business owners trying to establish their web presence, there’s a lot of puzzle pieces to manage.
The challenge to overturn Quill v. North Dakota was brought to the Supreme Court by South Dakota. South Dakota passed a law two years ago demanding that all retailers that, on an annual basis, have more than $100,000 in annual sales or engage in 200 or more separate transactions, pay a 4.5 percent tax on all sales, “as if the seller had a physical presence in the State.” The state government then filed suit to have the case heard by higher courts, and the Supreme Court agreed to hear the argument earlier this year.
One small business owner Chad White, the owner of Class-Tech Cars, a Virginia-based small business that sells reproduction automotive parts online, recently testified before Congress that he has a part-time employee who — before the Wayfair decision — was able to collect and remit all applicable sales taxes in just a few hours each week. However, White said the ruling in the case “gives me, and millions of small businesses across the country, pause as we consider what lies ahead for Internet-enabled entrepreneurs.”

At the more advanced levels of a marketing program, students will hone the skills that are most important to their areas of emerging expertise to create sharp minds and strong portfolios on their way to the workplace.
Shifting the focus to the time span, we may need to measure some "Interim Metrics", which give us some insight during the journey itself, as well as we need to measure some "Final Metrics" at the end of the journey to inform use if the overall initiative was successful or not. As an example, most of social media metrics and indicators such as likes, shares and engagement comments may be classified as interim metrics while the final increase/decrease in sales volume is clearly from the final category.
Online reviews have become one of the most important components in purchasing decisions by consumers in North America. According to a survey conducted by Dimensional Research which included over 1000 participants, 90% of respondents said that positive online reviews influenced their buying decisions and 94% will use a business with at least four stars. Interestingly, negative reviews typically came from online review sites whereas Facebook was the main source of positive reviews. Forrester Research predicts that by 2020, 42% of in-store sales will be from customers who are influenced by web product research.
In China, the Telecommunications Regulations of the People's Republic of China (promulgated on 25 September 2000), stipulated the Ministry of Industry and Information Technology (MIIT) as the government department regulating all telecommunications related activities, including electronic commerce.[36] On the same day, The Administrative Measures on Internet Information Services released, is the first administrative regulation to address profit-generating activities conducted through the Internet, and lay the foundation for future regulations governing e-commerce in China.[37] On 28 August 2004, the eleventh session of the tenth NPC Standing Committee adopted The Electronic Signature Law, which regulates data message, electronic signature authentication and legal liability issues. It is considered the first law in China's e-commerce legislation. It was a milestone in the course of improving China's electronic commerce legislation, and also marks the entering of China's rapid development stage for electronic commerce legislation.[38]
3.  Due Process Clause.  The provisions of M.G.L. c. 64H, § 1 are enforced subject to the limitations of the Due Process Clause of the U.S. constitution.  See Quill Corp. v. North Dakota, 504 U.S. 298 (1992).  In the instance of a vendor with a principal place of business located outside the state, due process generally requires that such vendor purposefully avail itself of the state’s economic market. See id.  The degree to which a vendor must purposefully avail itself of a state’s economic market to meet the requirements of due process can be uncertain in the instance of Internet vendors with a principal place of business located outside the state.  Therefore, 830 CMR 64H.1.7(3) sets a bright line threshold intended to reflect a level of purposeful availment at which the requirements of due process will be met in the case of such vendors.
It's worth noting that the Supreme Court did not legitimize any one federal standard for the collection or remittance of sales tax, and that could create a compliance headache for entrepreneurs in the meantime. In the June Wayfair decision, it recognized the state of South Dakota's threshold of $100,000 in sales, or a 200 in-state transaction minimum, before which startups should not be required to charge extra. But there are more than 10,000 state jurisdictions that govern sales tax, each of which may have unique requirements for how--and how much--tax online retailers should be collecting.
(b)   A provider of Internet access service or online services (a “provider”) is not deemed to be the agent of a vendor for purposes of determining the application of 830 CMR 64H.1.7(3) to such vendor solely as a result of:  1. the display of such vendor’s information or content on the provider’s out-of-state computer server, or  2. the processing of orders through the provider’s out-of-state computer server.  See id.
“For years, brick-and-mortar retailers have suffered at the hands of online sellers, not only from whatever superior service or features are offered by the online sellers, but by the tax exemption they enjoyed under previous law,” he said. “This decision corrects that. If online sellers provide a superior product, that’s the nature of competition, but they should not enjoy a legislated advantage in the tax code.”

The Wayfair ruling could also have wide-ranging consequences for marketplaces such as Amazon and Etsy, where the companies already collect sales tax on their own products, but not on behalf of third-party sellers. This brings up the question of whether marketplaces will now step in to absorb the cost of collecting sales tax on behalf of partner retailers. In some states, notes Barrett, "marketplace facilitator legislation would require the Amazons and the Etsys to collect sales tax on their behalf. In some respects, that would be easier for the smaller sellers," she adds. Still, it's conceivable that marketplaces could refuse to do so in other states--or sell hefty compliance assistance packages that would hurt their sellers, she suggests.

Regardless of what happens with the proposed federal legislation, the Supreme Court's decision in the Wayfair case is expected to mean the collection of substantially more money for states from sales tax. And for remote sellers, the decision may mean they will need sales tax software to keep up to date on which states and localities collect sales tax and at what rate.
In June, the High Court issued a ruling in the case of Wayfair v. South Dakota, allowing states to require online retailers to collect sales tax--even in areas where they don't have a physical presence. It has been a month since the decision, and already many small businesses are considering their options for how to address, among other things, higher tax-compliance costs in a potentially reduced-sales environment.
