A fulfillment center is a location, generally a warehouse facility, where orders for tangible personal property are received, packaged, and picked up by common carrier for shipment to the customer. Some sellers use their own fulfillment centers to fulfill all of their orders, including orders processed by marketplace operators. Other sellers contract with a third-party that operates a fulfillment center (fulfillment center operator) to fulfill their orders. For many years, states argued that they were losing a lot of money by not being able to collect sales tax on Internet sales to customers located in their states. Formerly the burden was on the customer rather than the seller to pay the relevant tax. Commonly marketers see increased sales among people exposed to a search ad. But the fact of how many people you can reach with a display campaign compared to a search campaign should be considered. Multichannel retailers have an increased reach if the display is considered in synergy with search campaigns. Overall both search and display aspects are valued as display campaigns build awareness for the brand so that more people are likely to click on these digital ads when running a search campaign (Whiteside, 2016).
Of course, plenty of small businesses--brick-and-mortar shops in particular--cheered the decision, which they say levels the playing field for all businesses that sell goods, whether online or off. With it, the High Court moved to overturn a 1992 ruling--Quill v. North Dakota, in which many small businesses gained a competitive advantage--holding that any seller must have a physical presence in a state in order to be required to collect and remit tax. In other words, if your company didn't have a physical presence in Ohio, you could avoid charging taxes on your Ohio sales.
(b) Prior Tax Periods. An Internet vendor may have engaged in in-state contacts other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c. during tax periods prior to September 22, 2017. In these cases, the vendor is liable for tax for such prior tax periods if: 1. the contacts created sales or use tax jurisdiction and; 2. the vendor did not collect and remit the tax. For example, for purposes of illustration only, an Internet vendor with a principal place of business located outside Massachusetts may have previously: a. owned or maintained inventory or other property in the state; or b. contracted with an in-state representative (including a related person) other than as referenced in 830 CMR 64H.1.7(1)(b)2.a. through c., and thereby created state sales or use tax jurisdiction. In these cases, the Internet vendor would have been subject to tax on all of its Massachusetts sales for the tax periods in question. Such a vendor may seek to use the Department of Revenue’s voluntary disclosure program for such prior periods.
Among emerging economies, China's e-commerce presence continues to expand every year. With 668 million Internet users, China's online shopping sales reached $253 billion in the first half of 2015, accounting for 10% of total Chinese consumer retail sales in that period. A 1992 Supreme Court decision (the Quill v. N. Dakota case) attempted to address the issue of internet transactions. According to the Tax Foundation, the Quill decision said that a business "must have a physical presence in a state in order to require the collection of sales or use tax for purchases made by in-state customers." This physical presence is called a tax nexus. The tax nexus concept originally meant a physical building, office, warehouse, retail store, or employees selling in the state.

Even so, not everyone is thrilled. "As a small-business owner, the ruling signifies additional risk, uncertainty, cost, and a likely chill on small to mid-size e-commerce business formation, growth, and hiring," says Stephen Culp, the founder and chairman of Smart Furniture. The Chattanooga-based online furniture retailer declined to disclose its annual revenue, though it notes that sales are in the tens of millions, with fewer than 50 full-time employees.
None of them ever passed, though. With the Supreme Court stepping into the fray on the Wayfair decision, it’s unlikely the federal government will be too anxious to dive back into this issue anytime soon. That said, as states get increasingly aggressive in their sales tax collection strategies, legal experts expect a long road of litigation and legislative changes ahead. That could provoke federal lawmakers to get involved.
