(a)   Statement of Purpose.  The purpose of 830 CMR 64H.1.7 is to explain how the general sales and use tax jurisdictional standard set forth in M.G.L. chs. 64H and 64I applies to vendors making Internet sales, taking into consideration the relevant provisions of the U.S. constitution and federal law. 830 CMR 64H.1.7 includes an explanation of the circumstances under which certain Internet vendors with a principal place of business located outside the state are required to register, collect and remit Massachusetts sales or use tax as set forth in M.G.L. chs. 64H and 64I.
For additional guidance, check Rule 3.286 under Title 34 of the Texas Administrative Code, which provides definitions of when a seller is engaged in business in Texas. The Rule includes a statement that a person does not have nexus with the state simply because he or she has a certificate of authority to do business in the state. The Rule also states that an out-of-state seller with nexus with the state must collect sales tax.
(b)  in any of the following activities with respect to the vendor’s products:  1. payment processing services; 2. fulfillment or storage services; 3. listing products for sale; 4. setting prices; 5. branding sales as those of the marketplace facilitator; 6. order taking;  7. advertising or promotion; or 8. providing customer service or accepting or assisting with returns or exchanges.

In cases where the online retailer does not have to collect sales tax, it is the customer’s responsibility to pay the tax—in which case it is known not as a sales tax but, rather, a use tax. The TCPA states on its use tax FAQ page that one of the most common reasons for a purchaser being subject to use tax is purchasing a taxable item from an out-of-state retailer without paying Texas tax and using the property in Texas. The FAQ page goes on to state that if a purchaser purchases merchandise "through a catalog or the Internet from a seller located outside of Texas and use[s] the taxable item in Texas," then the purchaser owes use tax on the purchase. You can find more formal guidance about the use tax in Rule 3.346 if the Texas Administrative Code.
Another disadvantage is that even an individual or small group of people can harm image of an established brand. Generally, remote sales by out-of-state retailers to California customers, whether made over the Internet, by telephone, or mail order, take place outside of California because the property is delivered to a common carrier outside the state for shipment into California, and are, therefore, not subject to sales tax. However, California customers do owe the use tax on those sales, unless a specific tax exemption or exclusion applies. Out-of-state retailers that are engaged in business in California are required to register with the California State Board of Equalization (BOE), collect the use tax from California customers, and pay the tax to the BOE.
