The challenge to overturn Quill v. North Dakota was brought to the Supreme Court by South Dakota. Amazon, the elephant in the room of the sales tax discussion, has changed its stand on the internet sales tax issue. Originally, the company fought to have internet sales tax imposed on purchases, but now it has distribution centers (tax nexus) in almost every states. In 2017, the company announced that it would charge sales tax on all its transactions, except for states that don't have sales tax. 

Sales taxes bring in big revenue for states, but they have to act carefully. If one state charges more sales tax than its neighbors, people start to cross state lines to buy big-ticket items. If the economy takes a dive and people buy less, states feel the crunch too. And more recently, buyers have started deliberately avoiding state sales taxes by buying on the internet. 
Beginning January 1, 2016, sellers of prepaid wireless phone cards and services are required to collect a Prepaid Mobile Telephony Services (MTS) Surcharge from customers and pay it to the BOE for all retail transactions occurring in this state. The surcharge is imposed as a percentage of the sales price of prepaid wireless cards/services sold in retail transactions occurring in this state. The Wayfair ruling could also have wide-ranging consequences for marketplaces such as Amazon and Etsy, where the companies already collect sales tax on their own products, but not on behalf of third-party sellers. This brings up the question of whether marketplaces will now step in to absorb the cost of collecting sales tax on behalf of partner retailers. In some states, notes Barrett, "marketplace facilitator legislation would require the Amazons and the Etsys to collect sales tax on their behalf. In some respects, that would be easier for the smaller sellers," she adds. Still, it's conceivable that marketplaces could refuse to do so in other states--or sell hefty compliance assistance packages that would hurt their sellers, she suggests.
(a)   Requirement to File Tax Return.  An Internet vendor subject to 830 CMR 64H.1.7(3) must file a tax return in the form and manner prescribed by the Commissioner and pay the tax due for each calendar month on or before the 20th day of the following calendar month, whether or not the vendor must collect any other local or state excises.  For applicable record retention requirements, see 830 CMR 62C.25.1:  Record Retention.

In the United Kingdom, The Financial Services Authority (FSA)[33] was formerly the regulating authority for most aspects of the EU's Payment Services Directive (PSD), until its replacement in 2013 by the Prudential Regulation Authority and the Financial Conduct Authority.[34] The UK implemented the PSD through the Payment Services Regulations 2009 (PSRs), which came into effect on 1 November 2009. The PSR affects firms providing payment services and their customers. These firms include banks, non-bank credit card issuers and non-bank merchant acquirers, e-money issuers, etc. The PSRs created a new class of regulated firms known as payment institutions (PIs), who are subject to prudential requirements. Article 87 of the PSD requires the European Commission to report on the implementation and impact of the PSD by 1 November 2012.[35]
A 1992 Supreme Court decision (the Quill v. N. Dakota case) attempted to address the issue of internet transactions. According to the Tax Foundation, the Quill decision said that a business "must have a physical presence in a state in order to require the collection of sales or use tax for purchases made by in-state customers." This physical presence is called a tax nexus. The tax nexus concept originally meant a physical building, office, warehouse, retail store, or employees selling in the state.
Affiliate marketing - Affiliate marketing is perceived to not be considered a safe, reliable and easy means of marketing through online platform. This is due to a lack of reliability in terms of affiliates that can produce the demanded number of new customers. As a result of this risk and bad affiliates it leaves the brand prone to exploitation in terms of claiming commission that isn’t honestly acquired. Legal means may offer some protection against this, yet there are limitations in recovering any losses or investment. To be clear, the South Dakota case on tax collection applies only to online retailers with more than $100,000 in annual sales or 200 transactions from the state. It remains to be seen how that threshold may play out with other states and whether most states would place the tax collection burden on third-party marketplace operators like Amazon, eBay or Etsy.
