As the National Taxpayers Union argued in endorsing the Sensenbrenner bill, “Absent congressional action, billions of dollars in interstate commerce and millions of small businesspeople face the threat of back-tax bills, complicated collection obligations, and nationwide tax and audit responsibilities simply for having the temerity to use the internet to reach buyers.”

In this new world of digital transparency brands have to be very thoughtful in how they engage with current and potential customers. Consumers have an endless amount of data at their fingertips especially through social media channels, rating and review sites, blogs, and more. Unless brands actively engage in these conversations they lose the opportunity for helping guide their brand message and addressing customer concerns.

While the physical presence rule may seem clear, this is not necessarily the case. In Quill, the Supreme Court discusses not only physical presence, but also several types of potential nexus (connections) between a business and a state. Many states, including Texas, have used the term nexus rather than physical presence in their sales tax laws, regulations, or other official documents, and have sometimes defined nexus in ways that could go beyond physical presence.
When writing this guide, we reached out to the marketer community to collect case studies and learnings about creative marketing strategies. In order to engage customers, retailers must shift from a linear marketing approach of one-way communication to a value exchange model of mutual dialogue and benefit-sharing between provider and consumer.[21] Exchanges are more non-linear, free flowing, and both one-to-many or one-on-one.[5] The spread of information and awareness can occur across numerous channels, such as the blogosphere, YouTube, Facebook, Instagram, Snapchat, Pinterest, and a variety of other platforms. Online communities and social networks allow individuals to easily create content and publicly publish their opinions, experiences, and thoughts and feelings about many topics and products, hyper-accelerating the diffusion of information.[22]
“For years, brick-and-mortar retailers have suffered at the hands of online sellers, not only from whatever superior service or features are offered by the online sellers, but by the tax exemption they enjoyed under previous law,” he said. “This decision corrects that. If online sellers provide a superior product, that’s the nature of competition, but they should not enjoy a legislated advantage in the tax code.”

Texas also has an annual sales tax holiday from the first Friday in August through to the following Sunday. The holiday covers certain clothing, footwear, backpacks, and school supplies costing less than $100 per item. The TCPA publishes awebpage and a FAQ page on the holiday. In addition, more detailed information is available in Rule 3.365 of the Texas Administrative Code.
By now, you've likely seen all the "gurus" in your Facebook feed. Some of them are more popular than others. The real question should be “how does the scam work?” so let me explain a little about how these business opportunity scams work so you know how to avoid them. But South Dakota, as well as a number of other states, asked the high court to overturn Quill, targeting the online home-goods retailer Wayfair and two other large online retailers with millions of dollars of sales to South Dakotans businesses, arguing that the state was missing out on revenue from online transactions, even though the companies have no physical presence in South Dakota. The Court agreed that the large retailers who were targeted by South Dakota were not protected by the Quill physical presence standard, but in overturning precedent the Court may expose millions of that protected small businesses to the from taxing authorities in other states.

Transaction.  A sale of tangible personal property or a service. The transactions of an Internet vendor include all such vendor’s transactions for tangible personal property or a service, however consummated, including transactions completed on a website operated by (a) such vendor; (b) a related person, or (c) a contract party, including a marketplace facilitator.
