Big retailers like Amazon are capable of deploying enterprise software that is sophisticated enough to account for different tax rates in multiple areas where a sale takes place. But if a five-person company with an Amazon, eBay, or Etsy store front, based out of a garage in Alabama, sells to a buyer in Chicago, they must now account for a 1.25% Chicago city sales tax, a 1.75% Cook County sales tax, the 6.25% Illinois sales tax, and a 1% “special” sales tax. That’s for just one sale to one city.

None of them ever passed, though. With the Supreme Court stepping into the fray on the Wayfair decision, it’s unlikely the federal government will be too anxious to dive back into this issue anytime soon. That said, as states get increasingly aggressive in their sales tax collection strategies, legal experts expect a long road of litigation and legislative changes ahead. That could provoke federal lawmakers to get involved.
(a) Requirement to File Tax Return. An Internet vendor subject to 830 CMR 64H.1.7(3) must file a tax return in the form and manner prescribed by the Commissioner and pay the tax due for each calendar month on or before the 20th day of the following calendar month, whether or not the vendor must collect any other local or state excises. For applicable record retention requirements, see 830 CMR 62C.25.1: Record Retention.

Those channels may also be supported by conversational commerce, e.g. live chat or chatbots on Web sites. Conversational commerce may also be standalone such as live chat or chatbots on messaging apps and via voice assistants.
"One vitalizing effect of the Internet has been connecting small, even ‘micro’ businesses to potential buyers" across the U.S., Etsy CEO Josh Silverman said in a blog post on the crafts marketplace's website. "People starting a business selling their embroidered pillowcases or carved decoys can offer their wares throughout the country — but probably not if they have to figure out the tax due on every sale.”
2, Dormant Commerce Clause. The provisions of M.G.L. c. 64H, § 1 are enforced to the extent allowed by the “physical presence” dormant Commerce Clause standard as set forth in Quill Corp. v. North Dakota, 504 U.S. 298 (1992), where a state sought to impose a use tax collection duty on an out-of-state mail order vendor on sales of tangible personal property shipped into the state. Unlike the mail order vendor at issue in Quill, Internet vendors with a large volume of Massachusetts sales invariably have one or more of the following contacts with the state that function to facilitate or enhance such in-state sales and constitute the requisite in-state physical presence:
(a) directly or indirectly, through one or more related persons in any of the following: 1. transmitting or otherwise communicating the offer or acceptance between a buyer and vendor; 2. owning or operating the infrastructure, electronic or physical, or technology that brings buyers and vendors together; 3. providing a virtual currency that buyers are allowed or required to use to purchase products from the vendor; or 4. software development or research and development activities related to any of the activities described in 830 CMR 64H.1.7(2): Marketplace Facilitator(b), if such activities are directly related to a physical or electronic marketplace operated by the person or a related person; and

One other source, a 2006 online publication from the Texas Comptroller of Public Accounts (TCPA) on Internet sales, states that businesses with “physical representation” in Texas must collect sales tax but an “out-of-state seller is not required to collect Texas tax if the seller only conducts business in Texas from out-of-state by mail, telephone, or via the Internet.”

A 1992 Supreme Court decision (the Quill v. N. Dakota case) attempted to address the issue of internet transactions. According to the Tax Foundation, the Quill decision said that a business "must have a physical presence in a state in order to require the collection of sales or use tax for purchases made by in-state customers." This physical presence is called a tax nexus. The tax nexus concept originally meant a physical building, office, warehouse, retail store, or employees selling in the state.
On June 21, 2018, the United States Supreme Court fundamentally changed the rules for collection of sales tax by Internet-based retailers. In its decision in South Dakota v. Wayfair Inc., the Court effectively stated that individual states can require online sellers to collect state sales tax on their sales. This ruling overturns the Court’s 1992 decision in Quill Corporation v. North Dakota. The Quill case prohibited states from requiring a business to collect sales tax unless the business had a physical presence in the state.
The first hurdle for online retailers is determining whether or not they’re even capable of scaling their finance and tax departments to collect this tax. All told, there are more than 15,000 different taxing jurisdictions in the U.S., consisting of labyrinthine mix of city, county, federal and state-level taxes, many of which apply different rates to different categories of products and can vary based on what side of the street a customer lives on.
