States would have to meet certain criteria to simplify their sales tax laws and make sales tax collection easier before they could require sellers to collect the tax.

In 2016, South Dakota passed a law that would require out-of-state retailers to collect and pay internet sales tax in the same way and at the same rate as in-state retailers. The only applies to larger retailers who have more than $100,000 in sales or more than 200 sales transactions in a year in the state, sparing smaller sellers from the requirement to collect internet sales taxes. The state law would use the presence of the buyer in the state (a destination-based tax) as the requirement for collecting internet sales tax.

The 1992 ruling from Quill v. North Dakota, focused on mail-order and catalog purchases, requiring that a business must have a physical presence within a state in order for the state to collect sales tax.
Some online marketplace operators display the property of various sellers, manufacturers and suppliers, and when a consumer purchases property through the marketplace the terms of sale dictate and the receipts and other documents related to the sale reflect that the consumer purchases the tangible property directly from the marketplace operator. In these instances, the marketplace operators are generally purchasing the property from the sellers, manufacturers or suppliers for resale, and then making a retail sale of the property to the consumer.
